EAGLE LAKE – During a special meeting on Monday, April 24, the Eagle Lake City Council met with Attorney Scott Bounds to seek or receive legal advice regarding pending or contemplated litigation; or a settlement offer. The consultation in accordance with Texas Government Code, Section 5551.071, was noted on the agenda.
The council went into executive session. After the session ended, the council determined that no action would be taken.
City Manager Charles “Tink” Jackson said that a new form has been created for the police department regarding filing complaints against a peace officer.
“We will get posted online with an explanation that from now, any complaint filed against a peace officer will have the most perjury attached to [the form] and will have to have that signature notarized before they can file those forms.”
Jackson said they will work on getting this information out this week.
Attorney Scott Bounds with Olsen and Olsen, LLP advised the council due to the city’s attorney not being available for the meeting. The city’s attorney is Art Pertile, III, also with Olson and Olson, LLP.
Prior to this special meeting, the council held a regular meeting on April 11 where Monrovia Fitzgerald spoke on behalf of her daughter Kirbrina Robinson to discuss the process of filing an internal affairs complaint against Officer Wesly Arrison from an incident that occurred Dec. 17, 2022.
The Citizen obtained a statement after that meeting from Officer Wesly Arrison that reads as follows: “I was recently made aware of a complaint brought against me stemming from an incident that occurred back in December 2022. Immediately following that incident, I initiated my own investigation for excessive use of force that was conducted by my department and the city of Eagle Lake. That practice is standard policy involving any use of force and I was cleared of any wrong doing.”
During that meeting, Jackson said that internal affairs complaints would need to be submitted in writing to proceed with moving forward.
